Participant Agreement, Parental Consent & Liability Waiver

This Participant Agreement, Parental/Guardian Consent & Liability Waiver (“Agreement”) governs access to and participation in the Miami Beach Youth Sports & Wellness Festival (“Event” or “YSW Fest”), produced by the Miami Beach Youth Sports Foundation, Inc., a Florida not-for-profit corporation (“Foundation”), in partnership with the City of Miami Beach (“City”).
Participation in the Event requires agreement to the terms below. By selecting “I Agree”, you acknowledge that you have read, understood, and accepted this Agreement for yourself and for any minor participant you are registering.
If a participant is under eighteen (18) years of age, the individual completing registration represents that they are the minor’s parent or legal guardian and have the authority to consent on the minor’s behalf.
I. Participant Eligibility & Parental Consent
Participation in the Event is voluntary. The parent or guardian represents that the minor participant is physically capable of participating in recreational and athletic activities and has no known medical condition that would prevent safe participation.
Participants and parents/guardians are responsible for determining whether participation is appropriate.
II. Nature of Activities & Assumption of Risk
The Event includes sports tournaments, clinics, demonstrations, games, and wellness activities.
Participation in athletic and recreational activities involves inherent risks including, but not limited to:
• falls or collisions with other participants
• sprains, strains, or other physical injuries
• equipment-related injuries
• environmental conditions such as heat or weather
• other risks associated with sports and physical activity
By agreeing to these terms, participants and parents/guardians voluntarily assume all risks associated with attendance at and participation in the Event.
Participants and parents/guardians agree to inspect facilities, equipment, and activity areas before participating and to notify event staff if any unsafe condition is observed.
III. Supervision of Minors
Parents or guardians remain responsible for the supervision, safety, and conduct of their children while attending the Event unless the child is actively participating in a supervised activity.
IV. Release of Liability
To the fullest extent permitted by law, participants and parents/guardians agree to release, waive, and hold harmless the Miami Beach Youth Sports Foundation, the Event, the City of Miami Beach, and their respective officers, directors, employees, volunteers, partners, and agents from any claims, damages, injuries, or liabilities arising out of or related to attendance at or participation in the Event.
V. Indemnification
Participants and parents/guardians agree to indemnify and hold harmless the Event, Foundation, and City from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from participation in or attendance at the Event.
VI. Code of Conduct
Participants, parents/guardians, and attendees are expected to maintain a safe, respectful, and family-friendly environment.
The Event reserves the right to remove any participant or attendee for behavior including:
• unsafe or disruptive conduct
• failure to follow safety instructions
• harassment or inappropriate behavior
• conduct inconsistent with the youth-focused nature of the Event
VII. Medical Authorization
In the event of illness or injury, participants and parents/guardians authorize Event staff or volunteers to:
• provide basic first aid
• contact emergency medical services if necessary
Participants and parents/guardians understand that the Event, Foundation, and City are not responsible for medical costs associated with treatment.
VIII. Media & Photography Release
Participants and parents/guardians grant permission for the Event, Foundation, and City to photograph or record Event activities that may include participants and attendees.
Images and recordings may be used for:
• event promotion
• community engagement
• educational materials
• social media and marketing
• City-supported communications
Participants acknowledge that no compensation will be provided for such use.
IX. Event Changes
Event programming, schedules, and activities may change due to weather, safety considerations, operational requirements, or other unforeseen circumstances. The Event reserves the right to modify or cancel activities as necessary.
X. Personal Property
Participants and attendees are responsible for their personal property. The Event, Foundation, City, sponsors, and volunteers are not responsible for lost, stolen, or damaged belongings.
XI. Governing Law & Dispute Resolution
Any dispute arising from this Agreement shall first be addressed through good-faith negotiations and, if unresolved, submitted to pre-suit mediation in Miami-Dade County, Florida before a Florida-certified mediator.
This Agreement shall be governed by the laws of the State of Florida, and any legal action must be brought in a state court located in Miami-Dade County, Florida. To the fullest extent permitted by law, the parties waive the right to a trial by jury.
Acknowledgment and Agreement
By selecting “I Agree”, you confirm that:
• you have read and understand this Participant Agreement
• you voluntarily accept the terms and conditions described above
• you assume the risks associated with participation in the Event
• you agree to the release of liability contained in this Agreement
• if registering a minor participant, you are the parent or legal guardian and consent to the minor’s participation
